1. PURPOSE
These terms govern the sale of the products presented on this site by the company:

These terms and conditions apply to the use of this website and by proceeding further and/or placing an order you agree to be bound by them. If you do not agree to be bound by them, you should leave this website now.

In placing an order on www.suparis.com Site you certify that you are an individual of legal age acting for yourself and not for any purpose relating to a trade, business craft or profession; you acknowledge that you have full legal capacity to agree to and accept these terms and conditions of sale when you enter into a transaction on www.suparis.com Site.
2. PRODUCTS
The presentation of products on www.suparis.com website does not constitute an offer, but merely an invitation to place an order. All goods are subject to availability and the details given are as accurate and complete as possible: the inclusion of any product on our site does not imply, warrant or guarantee that the product will be available if you wish to place an order to purchase it. We take all reasonable measures to ensure that details, measurements, descriptions and price (see article 2) of the products given on this website are as accurate and complete as possible. SU will have the right, at any time, to make changes to information about the products displayed on our site, for example information about prices, description or the availability of the products and we may do so without first giving you notice of the changes. SU will not, however, make any changes to the price, availability or description of any products after we have accepted an order to supply the product to you.
Although SU endeavor to verify the accuracy of the published information on the website in the form of advertising or in a catalog, it provides no warranty, express or implied, regarding the accuracy, reliability or completeness of such information. If the correct price of a product SU is higher than the price published on our website, then SU will contact the customer to obtain his instructions before shipping the order. If SU cannot get your instructions SU can reject the order and notify you of such rejection.
Although SU strives to ensure that descriptions, photographs or products graphics representation posted on the website, SU does not guarantee that those or other content are free of errors, whether following an inaccuracy, omission, an obsolete element or for any other reason. Accordingly, the sole remedy of the customer in the event of an error of this type is to return the product as indicated in our return policy.
3. PRICES
Pricing and currency are displayed according to the IP address of your device. The final price, the official duties and taxes will be determined by the shipping address entered at checkout.
For EU resident clients and/or with a EU shipping address : All prices shown on the Product pages of the Website are in euros, including VAT as applicable in France, but not the delivery costs and any other taxes, unless stated otherwise. All prices includes the applicable VAT at the date of the order. If said legal rate is modified, it will be reflected on the products price.
For non EU and non US resident clients and/or with a non EU or non US shipping address : All prices shown on the Product pages of the Website are in euros (excluding VAT), without Customs fees, delivery costs and any other taxes, unless stated otherwise.
For US resident clients and/or with a US shipping address : All prices shown on the Product pages of the Website are in US Dollars, including the customs and duties costs, but not delivery costs unless stated otherwise
In any case, SU reserves the right to modify prices and delivery costs at any time without prior notice. The price of a Product and delivery costs displayed on the as indicated at the time SU provides you with a Confirmation of Order, will be honored by SU.
The recipient of an international shipment outside the EU may be subject to import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country. Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and can't predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for more information. The recipient is the importer of record and must comply with all laws and regulations of the destination country. Your privacy is important to us and we know you care about how information about your order is used and shared. We'd like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
4. ORDER
Each order submitted on our website does not bind you, but constitutes an offer from you to purchase the relevant product from us in return for payment by you correlating to the prices displayed at the time the order was placed. Our Website ordering process allows you to check and amend any errors in your order before submitting your order to us. You should carefully check all details before placing your order on the Website. Orders are subject to our acceptance and we may, at our discretion, refuse to accept your order, including where:
- Orders cannot be processed due to an error in information you have provided to us. For example, where you provide us with an incorrect payment card number; insufficient or an incorrect shipping address or a wrong phone number; or fraudulent information;
- there is an error on our site relating to the product you have ordered. For example an error relating to the price or description of the product as displayed on our site;
- the product you have ordered is no longer available through our site
Once SU has received your order through our site we will send you an email to the email address you have provided to us acknowledging receipt of the order. If we are unable to accept your order, other than for fraudulent purposes, we will send an email informing you of the reason for the rejection. You should note that the email that we send to you confirming receipt of your order does not constitute acceptance of your order, but only an acknowledgement that we have received it.
After receiving your order, we will check that the relevant products are in stock. Our contract will only be concluded and SU will only be deemed to have accepted your order (or any part of your order) once the requested product has been shipped and we have sent a shipment confirmation email to you confirming that all or part of the product ordered is still available and has been shipped. The contract will only relate to that part of the order of product which has actually been shipped and no contract will have been created in respect of any product which you may have ordered which we were unable to ship.
5. PAYMENT
We accept Visa®, MasterCard®, and American Express®, ApplePay® and PayPal® are available for purchases made in € for Europe and the rest of the world, and in USD$ for the USA.
When we receive your order, we will place a "hold" on your Visa®, MasterCard®, American Express®, Credit card, ApplePay® or Paypal® for the total value of your order. If the "hold" on your card has been authorized by your bank or building society, we will take payment for the product from your card when your product, or the first part of the product that you have ordered, is dispatched.
You should note that placing a "hold" on your Visa, MasterCard, Credit card or Paypal account, does not constitute acceptance of your order. Our contract is created only when we send you an email confirming that we have dispatched your product or the first part of the product covered by your order.
The charge for your order will appear on your credit, debit or charge card statement as "SU PARIS" If you wish to dispute the validity or amount of a charge that appears on your credit, debit or charge card statement, please contact us at : customercare@suparis.com
If you cancel an order, or an item in your order, as herewith stated, any authorized "hold" on your Visa, MasterCard, American Express, Credit card or Paypal account, will usually be released within three (3) to five (5) working days from the date of cancellation.
Online payment with Paypal: In the case of a settlement with Paypal, the Customer with a PayPal account enters his/her email address linked to his/her PayPal account and his/her PayPal password. PayPal encrypts all information that the Customer has communicated. Thus, no information other than the email address of the Client is communicated to SU.
The financial and personal information is encrypted automatically when sending sensitive information to PAYPAL servers. For more information on the security of transactions between the Customer and PAYPAL, SU invites to revert to PAYPAL.
In the case of a return, refund will be made in the form of crediting the PayPal account used for the settlement of the original order. When ordering Products on the Website you, as the Customer, will receive an invoice with your product(s).
If you purchase a Product as a gift for a third person ("Gift Recipient"), the invoice will be sent to the address indicated when purchasing. SU will never send the invoice and payment details to the Gift Recipient.
We remain the owners of the purchased product until full and final payment of all sums due for the order has been received.
6. SECURITY ON THE WEBSITE
In order to offer secure payment, the SU PARIS.com site uses the secure payment services of Mollie. This service conforms to SSL secure online payment norms. Confidential information (the 16-figure credit card number, expiration date and card verification code) are transmitted in encrypted form on the SIPS server without ever passing through the SU company's server. After confirmation of the order, the payment request is routed real time in the secure automatic payment system of Mollie, where a request for payment authorization is made to the credit card network. The automatic payment system then produces an electronic certificate.
7. DELIVERY
Once your order is placed, an order confirmation will be sent to you by email. In addition, a shipping confirmation will be emailed to you once your order has been shipped. Once your order has been processed you will receive an email update with tracking information. We dispatch orders placed within 2 business days from the date that we receive and confirm your order. Please note that the shipping delivery timeframes do not include order processing time, week-ends/holidays and any customs clearance delays that may arise. All shipments will require a signature upon delivery. We do not ship to PO box.

- Express (Next day) : 15€ (orders placed on Friday will be delivered next Monday)
EUROPE
- Express (1-4 working days) : 15€ / Free on orders over 400€
USA
- Express (1-4 working days) : 25$ / Free on orders over $500
UK & INTERNATIONAL
- Express (1-6 working days) : 25€ / Free on orders over 500€
Customs & Duties for International orders :
- For our UK & International customers, customs duties and taxes are paid by the receiver and are not included in our prices.
- We recommend that you contact your local customs authority to determine import taxes and costs prior to submitting your order.
- If you refuse any shipments from SU, you are responsible for the original shipping charges, any duties, taxes and/or customs charges, as well as the cost of returning the package to SU. This amount will be deducted from your refund once the return has been processed.
- Our shipping partners will contact you when your order arrives to arrange for the payment of the import fees to clear your item(s) for delivery.
COVID 19 : We are working closely with our logistic/delivery partners to ensure orders reach you as soon as possible, however please note that deliveries may take a little longer than usual.
* Saturday and Sunday will not be considered as a regular business day with respect to estimated delivery time.
SU insures each purchase during the time it is in transit until it is delivered to you. We require a signature by a person who has reached the age of majority to confirm your acceptance of each Product delivered, at which point risk and responsibility for your purchased Products pass to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you understand and accept that evidence of a signature by such recipient (or at that delivery address) is evidence of delivery and fulfillment of the sale contract and transfer of risk and responsibility to the recipient in the same way as if the Product had been delivered to you.
8. RIGHT TO CANCEL, RETURN, REFUND
You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day, on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right to cancel, you must use the cancellation form hereunder at : customercare@suparis.com
Process
To process your return please email us at customercare@suparis.com within 14 days of receiving your order for a return authorization. We will then inform you about the next steps. Items returned without prior agreement cannot be accepted and will be returned to you at your expense. We cannot make any exceptions outside of the 14-day time frame. All items must not be worn, washed or damaged, and must have all tags attached and shipped back in its original condition in order to be eligible for a return. Please note that any returns received which do not meet our return policy requirements may be refused and shipped back to you at your expense.
Once received, returns take up to 2 business days to process. Upon completion, you will receive a confirmation email. The return will be refunded via the original form of payment, please allow up to 7 business days for your refund to appear on your statement.
FRANCE : Free returns (Please note you will not be refunded original shipping costs if charged)
EUROPE : Flat rate : 20€ which will be deduced from your refund (Please note you will not be refunded original shipping costs if charged)
UK & INTERNATIONAL : Flat rate : 30€ which will be deduced from your refund (Please note you will not be refunded original shipping costs if charged)
US : Flat rate : $30 which will be deduced from your refund (Please note you will not be refunded original shipping costs if charged)
Refund
Should a Product be returned to SU Returns Department, only a Customer will be entitled to receive a refund. In no event will a Gift Recipient be entitled to receive a refund. Initial delivery charges will not be refunded to the Customer. The purchase price of the Product and the costs of its delivery to you will be refunded to Customer’s account no later than thirty (30) days of the day on which you communicated your decision to cancel the contract and return the Product to SU.
Exchange
To process an exchange please email customercare@suparis.com within 14 days of receiving your order. Exchanges are shipped to you free of charge, except for International orders. We can not offer exchanges to International customers, if you wish to exchange please request a return authorization to return your item(s) for a refund and place a new order.
Legal warranty against hidden defects - Non-conforming Product
The Products sold on the Site are subject to the terms of legal warranties provided for in Articles L211-4 to L211-13 of the French Consumer Code and in Articles 1641 and 1648 of the French Civil Code to the exclusion of all and any other warranties:
- legal warranty against hidden defects: SU shall deliver to the customer goods which are exempt of any hidden defects which render them unfit for the use for which they were intended, or which so impair that use that the buyer would not have acquired them, or would only have given a lesser price for them, had he known of such defects
This warranty shall only take effect on condition that the customer requests it within two years of detecting the defect.
SU is extremely cautious in ensuring that each Product strictly complies with its quality criteria and that it has passed all our controls, both technical and aesthetic. If nevertheless you or the Gift Recipient receive a Product which seems defective or are not as described on the Website (“Non-conforming Product”), you or the Gift Recipient may return it to SU as per the return process outlined above. Upon receipt, SU may classify the Product as a defective Product. Please note that Products that are damaged as a result of wear and tear or washed in contradiction with our instructions are not considered to be defective.
Returning a presupposed defective Product can only be done in a 6 months period as from the date of delivery. Beyond this 6 months period you will have to evidence that the Product was defective at the date it was delivered.
If SU concludes that the Product is a Non-conforming Product, you or the Gift Recipient, as applicable, may require SU to:
(i) Replace it with an identical Product, subject to availability;
(ii) Repair the Product (if such repair is commercially reasonable); or
(iii) Refund the full price of the Product to the Customer (not to the Gift Recipient).
SU may also (but is not obliged to) offer to exchange the Non-conforming Product for another Product of equivalent value or of greater value (in the latter case, subject to the payment by the Customer of the price difference). Such exchange shall be made in accordance with the exchange rules of these Conditions of Sale.
If you or the Gift Recipient do not agree with SU’s conclusion as to whether the Product is a defective Product, SU may (but is not obliged to) carry out further independent testing and inspection. You or the Gift Recipient will be charged for this inspection if the inspector concludes that the Product was not defective. This, however, does not affect your statutory rights.
9. LIABILITY
As regards all stages of access to the site, of ordering processes, delivery or subsequent services, SU PARIS only accepts partial responsibility. SU PARIS cannot be held liable for any inconvenience or damages caused by the use of the internet network, such as a breakdown in the service, outsider intrusion, the presence of any computer virus or any event of force majeure, as legally defined. Furthermore, SU PARIS declines all legal responsibility for any failure to comply with contractual obligations in the case of force majeure or unforeseen circumstances, including, but not as an exhaustive list, internal or external company strikes, fire, catastrophe, internal or external breakdowns, and any event in general that could affect the completion of an order.
10. FINAL PROVISIONS
Agreement. These Conditions of Sale (as amended from time to time), including policies incorporated herein, constitute the agreement between you and SU regarding your purchase of Products through the Customer Service Centre or the Website and supersedes any other agreement or understanding, arrangements, undertaking or proposal, written or oral, between you and SU in relation to such matters. In the event any other rules, code of conduct, or other matter posted on the Website conflicts with the terms of the Conditions of Sale, the Conditions of Sale shall govern. No oral explanation or oral information given by any party shall alter the interpretation of the Conditions of Sale.
Severability. In the event that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.
Governing Law and Jurisdiction. These Conditions of Sale are governed by French law. This means the contract for the purchase of the Products and any dispute or claim arising out of or in connection with it will be governed by French law. You and we agree to that the courts of Paris will have exclusive jurisdiction.
Mediation. Consumers have the ability to follow a mediation procedure or any alternative dispute resolution scheme in the event of a dispute.
